Birdhouse – Class & Event Terms & Conditions
By registering for or attending a Birdhouse class, event, workshop, or birthday party (“Event”), you agree to the
following terms and conditions.
1. Participation & Supervision
Birdhouse offers non-medical, recreational, and educational programming for children and adults, including music,
art, movement, and enrichment activities.
- Parents or legal guardians are responsible for determining whether an Event is appropriate for their child.
- Children must be supervised according to the Event’s age guidelines.
- Birdhouse staff and instructors are not responsible for individual child supervision unless explicitly stated.
2. Assumption of Risk
You understand that participation in Events may involve normal risks associated with group activities, including but
not limited to minor injuries, falls, or accidental contact with others.
By enrolling, you voluntarily assume all such risks on behalf of yourself and/or your child.
3. Release of Liability
To the fullest extent permitted by law, you agree to release and hold harmless:
- Birdhouse
- Wellness on Wellwood, LLC
- Event instructors, staff, contractors, and affiliates
from any claims, demands, or liabilities arising out of participation in Events, except in cases of gross negligence
or willful misconduct.
4. Medical Disclaimer
Birdhouse Events are not medical, therapeutic, or clinical services.
- No medical advice, diagnosis, or treatment is provided.
- Participation does not create a healthcare provider-patient relationship.
If your child has allergies, medical conditions, or special needs, it is your responsibility to notify the
instructor prior to the Event.
5. Photo & Video Release
You grant Birdhouse and Wellness on Wellwood, LLC permission to photograph and/or record you and/or your child during
Events.
These images and recordings may be used for:
- Marketing
- Social media
- Website content
- Promotional materials
This release is granted without compensation and may be revoked in writing at any time for future use.
If you do not wish for your child to be photographed, please notify us in writing prior to the Event.
6. Cancellation & Refund Policy
- All sales are final unless otherwise stated.
- Missed classes or Events are not eligible for refunds.
- Credits or make-ups may be offered at Birdhouse’s discretion for certain programs.
Event-specific cancellation policies may apply and will be clearly communicated at registration.
7. Illness & Safety Policy
For the safety of all participants:
- Please do not attend Events if you or your child is ill, contagious, or experiencing symptoms such as fever, vomiting, or rash.
- Birdhouse reserves the right to deny participation if a child appears unwell.
8. Behavior Expectations
Birdhouse is a welcoming, inclusive space.
- Disruptive, unsafe, or inappropriate behavior may result in removal from an Event without refund.
- Parents and guardians are responsible for their child’s conduct.
9. Independent Instructors
Some Events are led by independent instructors or organizations.
- These instructors are responsible for their own programming and insurance.
- Birdhouse provides the space but is not responsible for the content or instruction of third-party Events.
10. Changes & Modifications
Birdhouse reserves the right to:
- Modify Event schedules, instructors, or content
- Cancel Events if minimum enrollment is not met
In the event of cancellation by Birdhouse, a credit or refund will be issued.
11. Governing Law
These Terms & Conditions are governed by the laws of the State of New York.
12. Acceptance of Terms
By completing registration and checkout, you acknowledge that you have read, understood, and agreed to these
Terms & Conditions.
